The 4SecureMail Service is provided to you ("User") under the terms and conditions of this 4SecureMail Terms of Service and any amendments thereto, and any subscriber agreement or service order executed by a User through the use of postal mail, fax, an online ordering form or by email . If there is any conflict between the Terms of Service and any other service order or agreement, the Terms of Service shall prevail. BY COMPLETING THE REGISTRATION PROCESS AND CLICKING THE "SUBMIT" BUTTON, YOU AND/ OR YOUR ORGANIZATION AGREES TO BE BOUND BY THE TERMS OF SERVICE.

USER CONDUCT

The 4SecureMail Service is provided to business, governmental or educational organizations, or to individuals who are at least 18 years of age. You agree not to use the Service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene, or that infringes or may infringe the intellectual property or other rights of another. You agree not to use the Service for the transmission of unsolicited emails, junk email, spam, chain letters or use email lists that contain any person that has not specifically agreed to be included on that list.

User is responsible for maintaining the confidentiality of the password and account, and is fully responsible for all activities that occur under User's password or account. User agrees to immediately notify 4SecureMail of any unauthorized use of User's password or account or any other breach of security. User agrees not to resell the Service or use of or access to the Service. You agree that 4SecureMail may in its sole discretion terminate your account, without notice, if you violate the Terms of Service.

ACCOUNT TERMINATION

User agrees that 4SecureMail or its EMPLOYEES may suspend or terminate User's password, account or use of the Service if 4SecureMail or its EMPLOYEES believe that User has violated the TERMS OF SERVICE.
4SecureMail may terminate your access to the Service and any related service (s) at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever. 4SecureMail has no obligation to store or forward the contents of your account.

EMAIL STORAGE AND SENDING LIMITATIONS

4SecureMail will not allow message storage to exceed the contracted amount of storage, measured in megabytes, for any User. 4SecureMail will not send or receive any message larger than the maximum size allowed by the particular service plan subscribed to by User, including any attachments. 4SecureMail will not send any message addressed or copied to more than twenty (20) recipients total, including To:, Cc:, and Bcc: fields. The amount of email storage space per User is limited. Some email messages may not be processed due to space constraints or outbound message limitations. 4SecureMail and its EMPLOYEES assume no responsibility for the deletion or failure to transmit, receive or store email messages. You agree that 4SecureMail is not responsible or liable for the deletion or failure to transmit, receive or store messages or other information.

LIABILITY LIMITATIONS

4SecureMail does not warrant that the Service will be without interruption or error free. User agrees that 4SecureMail and its employees shall not be liable for any damages arising from interruption, suspension or termination of service. User agrees that 4SecureMail and its employees shall not be liable for any direct, indirect, incidental, special or consequential damages, loss of profits, loss of use, loss of data or other tangible or intangible loss or damage, even if 4SecureMail or its employees has been advised of the possibility of such damages.

BILLING AND INVOICING

4SecureMail does not send out paper invoices. Invoice for current amount due, along with receipts for past payments can be obtained within the Billing Interface. It is the responsibility of the user to make sure payment is received by 4SecureMail before account renewal date to avoid service disruption or account cancellation. If user has opted for auto-recurring credit card renewal, user authorizes 4SecureMail to charge the credit card on file on or about each renewal date for current amount due as long as the account remains open. In addition, user agrees to keep billing information accurate within the Billing Interface to prevent declined auto-payments and resulting service disruption or account cancellation.

GENERAL

The information and services included in or available through the Service may include inaccuracies or errors. 4SecureMail may make changes and/or improvements to the Service at any time without notice. 4SecureMail has the right at any time to change or discontinue any aspect of the Service provides, including the content, hours of availability, and equipment needed for access to or use of 4SecureMail. 4SecureMail may at its discretion modify or prohibit the registration of any user ID or username. 4SecureMail provides its Service "as is". The Company makes no warranty or covenant in regards to the availability, reliability, or timeliness of the Service. 4SecureMail is not responsible for the suitability or fitness for purpose of the Service for any purpose. 4SecureMail considers email transmitted via the Service to be the private correspondence between the sender and recipient. 4SecureMail does not monitor, edit or disclose the contents of a User's private communications, under any circumstances, unless required by law. You indemnify and hold harmless 4SecureMail, its parents, subsidiaries, officers and employees, for any third party claim, demand, or damage, including reasonable attorneys' fees, arising out of your use of the Service.

NOTICE AND MODIFICATIONS

4SecureMail reserves the right to review, alter, amend or replace in its sole discretion, the Terms of Service. Any notice to User shall be deemed sufficient if made via email to any address known by 4SecureMail including any address(s) provisioned on the 4SecureMail system.
